Abkhazia's Parliament discusses working group's proposals on judicial reform

SUKHUM -- At a meeting of the Committee of the People's Assembly of Parliament of the Republic of Abkhazia on legal policy, state-building and human rights were discussed the results of the working group of the National Assembly of the Parliament of the Republic of Abkhazia on judicial reform.

The meeting was chaired by the Parliamentary Committee on Legal Policy, State Building and Human Rights - the head of the working group Valeriy Agrba. It was attended by members - Aslan Kobakhiya and Robert Yaylyan, as well as the members of the working group: the President's representative in the People's Assembly of the Parliament of the Republic of Abkhazia -Dmitriy Shamba, the chairman of the Supreme Court of the Republic of Abkhazia Roman Mushba, Judge of the Supreme Court of the Republic of Abkhazia Temur Shoniya, Chief of Staff of the People's Assembly of the Parliament of the Republic of Abkhazia Vadim Bzhaniya, Head of legal and Analytical Department of the People's Assembly of the Parliament of the Republic of Abkhazia Gennadiy Stepanov.

The Parliamentary Working Group on the draft law of the Republic of Abkhazia on judicial reform was established on July 25, 2012.

December 8, 2014 a working group of the National Assembly of the Parliament of the Republic of Abkhazia on judicial reform has finalized 41 of the bill, among which are:

The Constitutional Law of the Republic of Abkhazia "On Judicial Power";

Code of the Republic of Abkhazia on constitutional jurisdiction;

Code of the Republic of Abkhazia on administrative proceedings;

Code of the Republic of Abkhazia on proceedings in cases of administrative offenses;

Law of the Republic of Abkhazia "On the regular number of judges of courts of general jurisdiction of the Arbitration Court of the Republic of Abkhazia";

Law of the Republic of Abkhazia "On the declaration of income, property and property obligations of the Republic of Abkhazia judges";

Law of the Republic of Abkhazia "On compensation for breach of the right to trial within a reasonable time, or right on the execution of the act within a reasonable time";

Law of the Republic of Abkhazia "On providing access to information about the activities of the courts in the Republic of Abkhazia";

Law of the Republic of Abkhazia "On Bailiffs";

Law of the Republic of Abkhazia "On state protection of persons participating in criminal proceedings";

Law of the Republic of Abkhazia "On state protection of judges";

Law of the Republic of Abkhazia "On disciplinary arrest of servicemen";

Law of the Republic of Abkhazia "On the administrative supervision of persons released

from prison";

Law of the Republic of Abkhazia "On electronic signature".

April 30, 2014 were adopted amendments to the Constitution of the Republic of Abkhazia, which laid the groundwork for the reform of the judiciary, a key element of which was the establishment of the Constitutional Court of the Republic of Abkhazia.

The goal of judicial reform is to ensure conditions for the development and improvement of the judicial system, training of judges and the quality of justice, the definition of the place of the judiciary as an important institution to ensure the independence and, at the same time, the responsibility of judges, as well as the implementation of human rights to fair trial solely on the basis of the rule of law, in accordance with international legal standards.

Draft Constitutional Law of the Republic of Abkhazia "On Judicial Power" on the form and structure of a codified act includes provisions governing the judiciary as a whole.

Also in the development of this bill was designed more than 40 bills that will create the necessary legislative framework for full reform and effective functioning of the judicial system.

During the last meeting it was decided the bills on the agenda of the next meeting of the session of the National Assembly of the Parliament of the Republic of Abkhazia for adoption in the first reading.
