Abkhazian Intelligentsia Urge Deputies for Prudent Decision-Making

SUKHUM / AQW'A ― A group of Abkhazian intellectuals has formally appealed to the Speaker and deputies of the People's Assembly-Parliament of the Republic of Abkhazia. Addressing the delicate issue surrounding the legislative process for the transfer of the Pitsunda dacha complex to the Russian Federation, their statement highlights legal concerns and implications for national sovereignty. Urging reconsideration, they emphasise transparency and the protection of national interests. The full statement that follows offers an in-depth perspective on this critical issue.

To the Speaker of the People's Assembly-Parliament of the Republic of Abkhazia, Lasha Nugzarovich Ashuba, and to the Deputies of the People's Assembly-Parliament of the Republic of Abkhazia:

Dear Lasha Nugzarovich and Esteemed Deputies,

We, the undersigned representatives of the intelligentsia, firmly believe that the legislative process concerning the transfer of the Pitsunda dacha complex property to the Russian Federation is a matter of extreme delicacy, directly impacting the territorial sovereignty of our state. The proposed bill for this session contains legal ambiguities and clauses that might lead to diverse legal interpretations and even contravene the Constitution of the Republic of Abkhazia.

Significant technical errors acknowledged by the Investigative Management of the General Prosecutor's Office of the Republic of Abkhazia were made during the Agreement’s preparation. Discrepancies between the geographical coordinates and the actual location of the Pitsunda State Dacha were discovered, with even part of the road to Ldzaa village being incorrectly included. Despite these grave errors, no one has been held accountable for such criminal negligence. This oversight reflects a grave disregard for critical matters like land management and cartography by the state bodies.

This situation begs the question of whether those advocating for such crucial and strategically significant matters for Abkhazia fully comprehend that they are dealing with concepts sacred to our people – the sanctity of our land, nature, subsoil, and protected areas, all pivotal to our ecological and resource functions. These treasures have been preserved and enriched through the immense efforts and sacrifices of the Abkhaz people and our valiant homeland defenders.

The Abkhaz public and intelligentsia perceive a lack of transparency in how these crucial issues are handled, leading to justified suspicions of manipulation by the Russian-Abkhaz oligarchy. This includes misuse of the esteemed name of the President of the Russian Federation, Vladimir Putin, who has been a vocal proponent of Abkhazia’s security and sovereignty. Attempts to label the true patriots of Abkhazia as anti-Russian only serve to undermine Russia's standing in a society historically friendly towards the Russian people and all ethnic groups in the Russian Federation. It's essential to remember that Abkhazia’s defence in 1992-1993 also protected Russia’s southern borders, a fact well known to the informed Russian citizenry.

We believe that the decision by Abkhazia's First President, Vladislav Ardzinba, to indefinitely entrust the Pitsunda state dacha to the Russian Federation, suffices to ensure its preservation, stability, and utility for various diplomatic, intergovernmental, political, and economic functions. The robust level of interstate relations between the Russian Federation and the Republic of Abkhazia should not degrade into contentious debates over the Pitsunda state dacha’s format and status.

Dear Speaker and Esteemed Deputies, as representatives of an independent branch of government, we urge you to find a mutually acceptable and civilised solution that excludes the transfer of ownership of the complex. Avoid setting a precedent that would diminish our independent, freedom-loving nation to a vassal state, a status we have endeavoured to escape for decades. Remember, every inch of Abkhaz soil has been hallowed by the blood of our ancestors.

To prevent further escalation in the country and to facilitate a reasoned consensus on the Pitsunda state dacha, the Parliament of the Republic of Abkhazia should establish a conciliation commission involving public representatives to judiciously address this matter. We hope that our elected representatives will demonstrate wisdom and alleviate the current societal tension.

Уважаемый Лаша Нугзарович! Уважаемые депутаты!

Мы нижеподписавшиеся считаем, что процедура законодательного оформления передачи в собственность РФ имущественного дачного комплекса «Пицунда»– вопрос чрезвычайно деликатный, затрагивающий территориальные аспекты суверенитета нашего государства. В выносимом на заседание сессии законопроекте есть юридические лазейки, пункты, допускающие двусмысленные правовые толкования. Есть положения, противоречащие Конституции РА.

Следует отметить, что в ходе подготовки Соглашения были допущены серьезные технические ошибки, подтвержденные и следственным управлением Генпрокуратуры РА. При сравнительном анализе географических координат, было установлено их несоответствие координатным точкам фактического адреса расположения объекта (Госдача «Пицунда»). Под отчуждаемую территорию подпала и часть дороги в с. Лдзаа. Однако никто не понес наказания за подобную преступную халатность. Допустив досадные оплошности, государственные органы проявили непростительное пренебрежение к таким важнейшим вопросам, как землеустройство и картографирование.

Невольно возникает вопрос: осознают ли лица, лоббирующие столь важные, стратегически значимые для Абхазии вопросы, что имеют дело с самым священным для нашего народа понятием – неприкосновенностью земли, природы, недр, заповедных зон, составляющих экологическую и ресурсную функцию. Все эти богатства сохранены и преумножены ценой огромных усилий и самопожертвования абхазского народа, доблестных и отважных защитников Отечества.

Общественность Абхазии, ее интеллигенция изначально не видят прозрачности в постановке судьбоносных проблем. Возникают небезосновательные подозрения, что этими процессами манипулирует российско-абхазский олигархат, спекулируя именем многоуважаемого Президента РФ  Путина В.В., который не раз заявлял, что Россия выступает гарантом безопасности Абхазии, ее суверенитета. Те, кто неуклюже и верноподданически пытается обвинить истинных патриотов Абхазии в антироссийской ориентированности, сами способствуют подрыву авторитета России в абхазском обществе, во все времена испытывавшем дружественные чувства к русскому народу, ко всем народам, проживающим в РФ. Никому не стоит забывать, что,  защищая себя в 1992-1993 гг., Абхазия защищала и южные границы РФ. И, слава Богу, все здравомыслящие граждане России знают об этом.

Мы уверены, что решение по госдаче «Пицунда», принятое в свое время Первым Президентом РА Владиславом Ардзинба, о передаче в бессрочное пользование РФ данного объекта, обеспечивает все необходимые условия для полноценной сохранности госдачи, ее стабильности, использования ее возможностей для любых дипломатических, межгосударственных, политических, экономических и иных предназначений. Высокий уровень межгосударственных отношений РФ И РА не должен быть опущен до скандальных разборок по формату и статусу пицундской госдачи.

Уважаемый спикер! Уважаемые депутаты!
Вы сегодня представляете независимую ветвь власти! Потрудитесь, найдите взаимоприемлемое цивилизованное решение, исключив передачу комплекса в собственность! Не создавайте прецедент, ставящий нашу независимую свободолюбивую страну в вассальное положение, от которого она избавлялась десятилетиями. Не забывайте, что каждый клочок абхазской земли обильно полит кровью наших  предков.

В любом случае, во избежание дальнейшего накала обстановки в стране, принятия разумного консенсусного решения по госдаче «Пицунда», Парламенту РА необходимо создать согласительную комиссию с участием представителей общественности и в спокойной атмосфере расставить все точки над i.
Выражаем надежду, что народные избранники проявят мудрость и снимут напряженность в обществе.
